Client privacy

TMA understands the importance of, and is committed to, complying with its obligations under the Privacy Act 1988 (Cth) (Privacy Act) and the associated Australian Privacy Principles (APP).

During the course of Client engagement, TMA may collect, use or disclose  information about the Client, pursuant for purposes associated with the provision of our services, marketing the products and services of the Client, and for research and statistical purposes.

TMA’s privacy policy prohibits disclosure of Confidential Client Information to third parties except to the extent when required for the provision of our services for the Client. TMA will take all reasonable steps to obtain assurances from any third-part entity to whom the Client’s confidential information is provided, including compliance with the privacy laws in the jurisdiction in which the recipient is located.

“Confidential Client Information” includes:

  • information relating to the personnel, policies, customers, product IP or business strategies of the Client;
  • know-how, trade secrets and techniques;
  • Information which, either orally or in writing, is designated or indicated as being the proprietary or confidential information of a party or which would reasonably be expected to be commercially sensitive or otherwise confidential.

but does not include information:

  • which is or becomes part of the public domain, except information that is or becomes so because it has been disclosed without the discloser’s authority; or
  • which is lawfully known to the recipient before the client engages with TMA; or
  • which is or becomes available to the recipient from another person who is in possession of it lawfully and can disclose it to the recipient on a non-confidential basis; or
  • which the recipient is required by law to disclose, but the recipient must inform the discloser first and seek to limit the terms of that disclosure in any manner the discloser reasonably requests.

 

Information/privacy breach response

Following a breach in confidential information/privacy data, TMA’s Information/Privacy Breach Response Plan and procedures are to be enacted as follows.

  • Identify the nature of the breach (by TMA Client Officer)
  • the time and date the suspected breach was discovered,
  • the type of personal information involved,
  • the cause and extent of the breach, and
  • the context of the affected information and the breach.

     

  • Contain the breach (by TMA Director)
  • the action taken by the Director or OAIC officer to address the breach or suspected breach,
  • the outcome of that action,
  • a view as to the seriousness of the breach, and
  • a view as to whether any further action is required.

     

  • Notify the discloser of the information on steps 1 and 2 (by TMA Director)
  • within 24hrs of the breach, citing;
  • the date, time, duration, and location of the breach,
  • the type of personal information involved in the breach,
  • how the breach was discovered and by whom,
  • the cause and extent of the breach.

     

  • Assess the risk for individuals and organisations associated with the breach and (by TMA Director)
  • a list of the affected individuals, or possible affected individuals,
  • the risk of harm,
  • whether other individuals/organisations should be notified.

     

  • Review the breach incident and take action to prevent further breaches (by TMA Director)
  • full audit as to the cause of the breach,
  • implementing a strategy to identify and address any weaknesses in data handling that contributed to the breach,
  • updating data breach response plan if necessary,
  • making appropriate changes to policies and procedures if necessary,
  • revising staff training practices if necessary.
